IRCC extends Interim Authorization to Work policy for TRVs in Canada until February 2023

 

Canada has extended temporary COVID-19 measures for another year for eligible Temporary Resident Visa (TRV) holders who are in Canada and want to apply for a work permit supported by a job offer without leaving the country. These pandemic measures, originally introduced in August 2020, will now be in effect until February 28, 2023.

 

The public policy not only allows valid TRV holders in Canada to apply for employer-specific work permits from inside Canada, it also allows eligible visitors to start working before even receiving the work permit.

This is a temporary regulatory change as normally foreign workers who are in Canada on a TRV cannot change status without leaving the country.

Eligibility criteria for visitors applying for employer-specific work permits

In order to be eligible, a foreign national must:

  • be in Canada;
  • have submitted an employer-specific work permit application using the Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker [IMM 5710];
  • have stayed in Canada with status since submitting the application;
  • submit the application before February 28, 2023.

Interim Authorization to Work

Prior to the pandemic, if you were a TRV holder, you could not apply for a work permit from within Canada. Instead, you could submit a work permit application while in Canada to your country of origin’s visa office. If your work permit was approved, you needed to physically leave Canada and re-enter for the work permit to take effect.

Due to COVID-19 measures, people could no longer flagpole. Flagpoling is when you leave Canada and return for the purposes of activating a temporary status. As such, in August 2020 Immigration, Refugees and Citizenship Canada (IRCC) started allowing TRV holders to submit work permit applications to IRCC from within Canada.

Although you can apply for a work permit from within Canada, you cannot work until IRCC approves the work permit. According to the IRCC website, this can take about 132 days.

In order to address this issue, IRCC introduced what is called an “Interim Authorization to Work.” Assuming you meet the eligibility criteria, you can get this authorization quickly. It enables you to begin working while IRCC processes your work permit application. The purpose is to enable those with an employer-specific job offer to begin work immediately. It is also intended to address labour shortages given the prolonged length of time it is taking IRCC to process work permit applications submitted inside the country.

One of the reasons IRCC is prioritizing people who held a work permit in the last 12 months is to help those who may have been laid off during the pandemic get back into the labour market more quickly.

A person’s work permit application can be rejected while on an Interim Authorization, but if the work permit application is approved, Interim Authorization allows TRV holders to start working more quickly than if they had to wait for a firm approval.

Eligibility criteria for Interim Authorization

Interim Authorization is not automatic. If you’re a visitor who is applying for a work permit in Canada and held a valid work permit in the last 12 months you can ask to be allowed to work while IRCC processes your application.

To meet the eligibility criteria you must:

  • be physically present in Canada when you apply;
  • be a visitor with valid status when you apply for the work permit;
  • if your visitor status has expired, you’ll need to restore your visitor status before you apply for a work permit;
  • applied for an employer-specific work permit between August 24, 2020, and February 28, 2023; and
  • have held a work permit that was valid in the 12 months before you applied for a new work permit.

It is then a two-step process to get interim authorization.

Step 1: Contact IRCC

After you apply for your work permit, fill out the IRCC Web form.

When you fill out the “Your enquiry” section, copy the text: Message to request interim authorization to work

Make sure you fill out the sections in square brackets, including the:

  • dates;
  • work permit number (begins with a “U”);
  • name of your employer; and
  • title of your job.

If you applied on paper and don’t know your application number, include your courier tracking number. This will ensure IRCC can find your application.

If you have other questions, you need to fill out a new IRCC Web form.

Step 2: Wait for IRCC to contact you

You must wait for IRCC to email you to let you know that you can start working. This may take up to 30 business days, which is about six weeks.

Express Entry: Canada invites 1,047 in new PNP draw

 

Canada invited 1,047 Express Entry candidates to apply for Canadian immigration on March 2.

 

Immigration, Refugees and Citizenship Canada (IRCC) only invited Provincial Nominee Program (PNP) candidates in the new invitation round. The Comprehensive Ranking System (CRS) cut off was 761. The minimum score was relatively high because PNP candidates get an automatic 600 points added to their score when they receive their nomination. Without the nomination, the lowest-scoring candidates would have had 161 base points.

Invited candidates now have 60 days to apply for Canadian permanent residence.

In the previous round of invitations, IRCC invited a total of 1,082 PNP candidates to apply for Canadian immigration. It was a record for the number of Express Entry candidates invited in a single round of invitations.

 

 

Minister says draws for skilled workers to resume in “near future”

Canada has not held an Express Entry draw for Federal Skilled Worker Program (FSWP) candidates since December 2020, and since September 2021 for Canadian Experience Class (CEC) candidates.

Canadian Immigration Minister Sean Fraser told business leaders in a webinar that IRCC would resume draws for skilled workers “in the near future.”

Although the immigration minister said there was no announcement on when skilled worker draws would resume, he said that Express Entry would start to look more normal in the coming years. According to the 2022-2024 Immigration Levels Plan, Express Entry targets will be cut in half for skilled workers this year, but will return to normal by 2024. These targets may change when Canada releases Immigration Levels Plan 2023-2025 in the fall.

 

Under the current levels plan, Canada is expecting to bring in 83,500 immigrants through both Express Entry-aligned and base PNP categories in 2022. The new targets are greater than what the government projected in the previous levels plan, which was 81,500 PNP immigrants for 2022, and 83,000 for 2023.

Despite the pause in FSWP and CEC draws, PNP draws continue in record numbers every two weeks. In February alone, IRCC issued 2,145 Invitations to Apply to provincial nominees, almost twice as much as the previous month when 1,428 PNP candidates were invited.

Fraser also said he was looking to add more flexibility to the Express Entry system. He suggested that Express Entry could be used to respond to short-term needs such as the needs of smaller communities, and certain in-demand sectors. The minister had previously hinted that occupation-specific Express Entry draws could be a possibility in the future.

What is Express Entry?

Express Entry is the application management system for three Canadian immigration programs: the Canadian Experience Class, the Federal Skilled Worker Program, and the Federal Skilled Trades Program. PNP candidates in the Express Entry pool have already qualified for one of these programs.

Express Entry uses a points-based system, the Comprehensive Ranking System (CRS), to rank candidates’ profiles. The top-scoring candidates receive an Invitation to Apply (ITA), and can then apply for permanent residency.

 

After the candidate applies, an IRCC officer reviews the application and makes a decision. The officer will ask for biometrics and may set up an interview or request more documents.

If the application is approved, IRCC issues a Confirmation of Permanent Residence (COPR). Approved permanent residents can then complete the landing process. If they are outside Canada, they can access pre-arrival services to help them with the first steps for settling in Canada.

Who was invited?

The following is a hypothetical example of someone who may have received an ITA in the new Express Entry draw.

Naveen is 39, holds a bachelor’s degree and has been working as an information system manager for six years. Naveen has an advanced English language proficiency and has never worked or studied in Canada. He entered the Express Entry pool with a CRS score of 386. He recently received a provincial nomination through Alberta’s Express Entry stream. His new CRS score of 986 would have been high enough to get an ITA in the new Express Entry draw.

As of February 28 at 12:01 a.m., Canada is allowing travellers to enter the country with a pre-arrival antigen test.

 

Before, travellers needed to have a molecular test, such as a PCR test, taken within 72 hours before their scheduled flight or arrival at the border.

All travelers to Canada age five and older still need a COVID-19 test before crossing the border. The new measures allow for incoming travellers to provide an antigen test result taken within one day before their scheduled flight or arrival at the land border. The test cannot be taken at home, it must be done by a laboratory, healthcare entity, or telehealth service, and be authorized by the country in which it was purchased. PCR tests are still accepted. No rules have changed for pre-arrival PCR tests.

In addition to the removal of the PCR test requirement, unvaccinated children would no longer have to isolate for 14 days, and international flights would resume at all airports.

 

If you have recovered from COVID-19

Travellers who continue to test positive for COVID-19 after recovering are allowed to board a plane, with some conditions. You need to provide a positive COVID-19 molecular test on a specimen collected at least 10 days and no more than 180 days before entering Canada as part of the pre-arrival test requirements.

ArriveCAN

All travellers still have to to submit their mandatory information via ArriveCAN. In coming travellers can use either the desktop of mobile app to submit their proof of vaccination in English or French, and a quarantine plan prior to arriving in Canada.

Travellers who are not fully vaccinated

Partially vaccinated and unvaccinated travellers will need to quarantine in a suitable place for 14-days, and take a mandatory COVID-19 test on arrival and on day 8.

Fully-vaccinated travelers

Fully-vaccinated travellers do not need to quarantine upon arriving to Canada, provided they meet the following criteria:

  • meet pre-entry testing requirements;
  • have no symptoms;
  • submit all required COVID-19 information to ArriveCAN and present their ArriveCAN receipt, pre-departure test results and paper or digital
  • proof of vaccination documents before they board their flight to Canada;
  • have a suitable quarantine plan in case they don’t qualify for the exemption.

Mandatory random tests upon arrival

Border services officers may randomly select you for a mandatory arrival test.

If you are fully vaccinated and are randomly selected for a mandatory arrival test, you must take the arrival test as directed on the day you enter Canada. You may get the test at the airport, or officials may give you a self-swab kit at the airport or land border to complete within 24 hours after entering the country.

If you are randomly selected for the on-arrival test, you do not have to wait for the results. You can travel to your final destination and take connecting flights, and you do not have to quarantine while waiting for your results.

The government of Canada says you can speed the process along by registering in advance with the testing provider for the airport you will arrive at using the same email address you used for ArriveCAN.

Modified quarantine for children age 12

Children under 12 years of age who are not fully vaccinated, travelling with fully vaccinated or medically exempt adults will be exempt from quarantine. They no longer need to wait 14 days before attending school, camp or daycare.

These children may be selected for mandatory random testing upon arrival, but they will not be required to quarantine while awaiting the test result.

Alberta creates new immigration program for tech workers

 

Express Entry candidates who work in tech may be eligible for Alberta’s new expedited immigration program.

Alberta is introducing a new fast-track immigration program for tech workers.

 

Alberta’s immigration minister, Tyler Shandro, announced the Accelerated Tech Pathway on January 13. The province had already began accepting applications to the new program in December.

In order to be eligible, tech professionals need to have a profile in the federal government’s Express Entry system and be eligible for the Alberta Express Entry Stream.

“Under this new pathway, tech professionals from across Canada and overseas can become permanent residents in as little as six months if they have a job offer in an in-demand tech industry occupation,” Shandro said, although Express Entry processing averaged nine months in 2020.

“Along with priority application processing, tech professionals will also receive a letter of support from the Government of Alberta if they require a work permit.”

 

There are more than 3,000 technology companies in Alberta, according to the Alberta Enterprise Corporation. Alberta’s tech sector has grown 233% since 2012, as per the 2021 Alberta Technology Deal Flow Study. However, tech companies still face challenges accessing workers, especially sales and technical talent.

Steps to applying for the Accelerated Tech Pathway

You have to first be eligible for the Alberta Express Entry Stream in order to be selected for expedited processing under the Accelerated Tech Pathway. This Provincial Nominee Program (PNP) has three steps:

1. Get a profile in the Express Entry system

The first step is to get into the Express Entry pool of candidates. You need to be eligible for one of the following three immigration programs: the Canadian Experience Class, the Federal Skilled Worker Program, and the Federal Skilled Trades Program.

To apply for the Accelerated Tech Pathway, you fill out and online form for the Alberta Immigrant Nominee Program (AINP). Through the form, you send information about your Express Entry profile and your tech job in Alberta.

In order to be eligible for the tech pathway, Express Entry candidates need to have a job offer, or be currently working for an Alberta-based company in an eligible occupation. The 23 eligible occupations are listed below in order of their National Occupational Classification (NOC) code:

  • 0013 Senior managers – financial, communications and other business services
  • 0112 Human resources managers
  • 0131 Telecommunication carriers manager
  • 0211 Engineering managers
  • 0212 Architecture and science managers
  • 0213 Computer and information systems managers
  • 0512 Managers – publishing, motion pictures, broadcasting and performing arts
  • 0601 Corporate sales managers
  • 1123 Professional occupations in advertising, marketing and public relations
  • 1121 Human resources professionals
  • 1223 Human resources and recruitment officers
  • 2131 Civil engineers
  • 2132 Mechanical engineers
  • 2133 Electrical and electronics engineers
  • 2147 Computer engineers (except software engineers and designers)
  • 2161 Mathematicians, statisticians and actuaries
  • 2171 Information systems analysts and consultants
  • 2172 Database analysts and data administrators
  • 2173 Software engineers and designers
  • 2174 Computer programmers and interactive media developers
  • 2175 Web designers and developers
  • 2221 Biological technologists and technicians
  • 2232 Mechanical engineering technologists and technicians

2. AINP determines your eligibility

The AINP checks that you meet the minimum eligibility criteria for the Alberta Express Entry Stream. If so, the AINP will send you an email inviting you to apply for a provincial nomination. You cannot apply without this invitation, and you cannot use a nomination under a different AINP stream to apply.

3. Apply

Once you receive the email invitation from Alberta, you determine if you meet the assessment criteria. If the AINP discovers fraud or misrepresentation in an application, they could ban you from reapplying for up to five years.

Completed applications go into a pool of eligible applications. The AINP considers these applications for a provincial nomination.

If Alberta offers you a nomination you have 30 days to accept using your online Express Entry profile. You will then get 600 Comprehensive Ranking System (CRS) points added to your Express Entry score.

The nomination does not guarantee that you will become a permanent resident, but it does boost you to the top of the Express Entry pool. You will get to apply for permanent residence once the federal government, Immigration, Refugees and Citizenship Canada (IRCC), sends you an Invitation to Apply (ITA) in an Express Entry draw.

Ontario PNP invites 502 Express Entry candidates

 

In its second draw in two days, Ontario invited 502 Express Entry candidates to apply for a provincial nomination on January 12.

 

Invited candidates had profiles in the Express Entry system with Comprehensive Ranking System (CRS) scores between 464 and 467.

In the new draw, the Ontario Immigrant Nominee Program (OINP) invited candidates who may be eligible for the Express Entry Human Capital Priorities Stream (HCP). This Provincial Nominee Program (PNP) gives foreign workers the opportunity to launch their careers in Ontario, and make Canada’s most populous province their new home.

The OINP invited candidates if they had work experience in one of the following 18 occupations listed in order of their National Occupational Classification (NOC) codes:

 

  • NOC 0114 – Other administrative services managers
  • NOC 0122 – Banking, credit and other investment managers
  • NOC 0124 – Advertising, marketing and public relations managers
  • NOC 0125 – Other business services managers
  • NOC 0211 – Engineering managers
  • NOC 0311 – Managers in health care
  • NOC 0601 – Corporate sales managers
  • NOC 0631 – Restaurant and food service managers
  • NOC 0711 – Construction managers

Invited Express Entry candidates need to have at least one year of work experience in one of these occupations in order to receive the provincial nomination. If they are nominated under this, or any other Express Entry-linked PNP, they will be bumped to the front of the line to receive an Invitation to Apply (ITA) for permanent residence.

What is Express Entry

Express Entry is an application management system for three Federal High Skilled immigration programs:  Federal Skilled Workers Program (FSWP), Federal Skilled Trades Program (FSTP), and Canadian Experience Class (CEC). Express Entry candidates may be eligible for one or more of these programs.

Once in the Express Entry pool of candidates, IRCC awards points to candidates based on their human capital factors such as age, work experience, education, language ability in English or French, and other factors. PEI releases 2022 PNP draw schedule

 

Prince Edward Island is the only Canadian province to make its PNP schedule public.

 

PEI has released its Provincial Nominee Program (PNP) draw schedule for the rest of the year.

The Prince Edward Island Provincial Nominee Program (PEI PNP) is the only PNP to release its draw schedule ahead of time. The province usually follows this schedule, except in 2020 when the pandemic halted operations around the world.

We can expect 12 PEI PNP draws in 2022. These draws invite immigration candidates who may be eligible for a provincial nomination under one of three categories: Express EntryLabour Impact and Business Impact.

About the PEI PNP Express Entry Category

The PEI PNP’s Express Entry Category is an enhanced PNP, which means it is linked with the federal government’s Express Entry system. In order to be considered for this stream, candidates need to have a profile in the system.

Express Entry is an immigration application manager. It handles the applications for three economic-class immigration programs: Federal Skilled Worker ProgramFederal Skilled Trades Program, and Canadian Experience Class.

Eligible candidates get a Comprehensive Ranking System (CRS) score for their age, work experience, education, and language proficiency in English or French.

Express Entry candidates who receive a provincial nomination are given an additional 600 points toward their CRS score and are effectively guaranteed an Invitation to Apply (ITA) for permanent residence in a subsequent Express Entry draw.

In order to be considered for a provincial nomination from PEI, Express Entry candidates need to create an Expression of Interest (EOI) profile with the PEI PNP.

EOI profiles are given points based on the province’s unique points grid. The highest-scoring candidates are then invited to apply through monthly draws.

Labour Impact Category

The Labour Impact Category is for foreign nationals who have a valid job offer in PEI, and have support from their employer. It is divided into three streams: Skilled WorkerCritical Worker, and International Graduate.

Candidates in this category must also submit an Expression of Interest in order to be considered for a provincial nomination through the Labour Impact Category.

Business Impact Category

Business Impact Category candidates need to meet the minimum provincial score requirement in order to proceed with their applications. The score is different in every draw. The invitations that the PEI PNP sent in today’s draw were issued under the Work Permit Stream, which is for foreign entrepreneurs who want to own and operate a business on the island.

Canada’s immigration backlog over 1.8 million applications in December

 

IRCC has more than 1.8 million applications in the queue, according to data from December.

 

CIC News obtained the data via an information request to Immigration, Refugees and Citizenship Canada (IRCC). The backlog includes future citizenspermanent residentsinternational studentstemporary workers, and visitors.

Adding up these categories brings the total to a backlog of 1,813,144 applications in December. In October, IRCC reported a backlog of 1,791,936. The difference means the backlog has grown by more than 21,000 immigration applications in a span of 49 days, a growth of 1%.

For most of these categories, except citizens, the new data reflect IRCC’s inventory as of December 15, 2021:

As of October 31, 2021, there are around 468,000 citizenship applications in the inventory, which is the same figure IRCC provided to CIC News for October 27 data. The immigration department did not provide more recent citizenship figures.

 

Express Entry and Family Class backlogs reduced, refugee backlogs increase

As of December, the Express Entry backlog was at more than 119,000, compared to October when it was nearly 138,000.

The difference was largely seen in Canadian Experience Class (CEC) applications, which was down to nearly 25,000 applications in December compared to more than 48,000 in October. The Federal Skilled Trades Program (FSTP) backlog also went down, 805 in the December queue compared to 931 in October.

 

The Federal Skilled Worker Program (FSWP) backlog increased to about 55,000 in December, whereas it was at nearly 51,000 in October. There was also an increase in the enhanced Provincial Nominee Program (PNP) backlog, 39,000 in December compared to 38,000 in October.

Overall family class applications were down to about 105,000 this past December, compared to more than 111,000 in October. This includes programs like spousal sponsorship, which was down slightly but remains around the 55,000 application mark, and the Parents and Grandparents Program (PGP), which was down to about 38,000 compared to more than 43,000.

In December, the backlog of protected persons (refugees and in-Canada asylum claimants) was almost 158,000. In October, it was about 153,000 applications.
